A woman is suing Elmwood Fitness Club, Harahan, LA, and other entities stemming from an injury her daughter allegedly suffered at the club.
Amanda Holmes claims in the lawsuit that her daughter broke her leg after she went down an inflatable slide at a birthday party at the club, The Louisiana Record reported Monday. When the child reached the bottom of the slide—which was sprayed with water—she slid into a wall and broke her leg, according to the legal journal.
The alleged incident occurred on Aug. 31, 2013. The lawsuit was filed April 17 in the 24th Judicial District Court in Gretna, LA.
Holmes filed the lawsuit individually and on behalf of her child against Ochsner Health Systems Inc., Kidsports Family Fun and Fitness, Elmwood Fitness Center and their insurers. Elmwood Fitness Center is a service of Ochsner Health Systems. Kidsports Family Fun and Fitness is located within the 175,000-square-foot Elmwood Fitness Center.
The defendant is accused of failing to maintain the premises in a safe condition, failing to adequately inspect the slide, failing to properly use the side, failing to properly train employees, failing to properly supervise employees, failing to institute reasonable safety measures, failing to enforce reasonable inspections, failing to meet a general standard of care, failing to follow slide guidelines and violation of state law.
An unspecified amount in damages is sought for pain and suffering, disability, aggravation, emotional distress, mental pain, anguish, loss of function, permanent physical impairment, scarring, disfigurement, loss of enjoyment of life, loss of personal property and medical expenses.
In 2012, a woman sued Elmwood Fitness Center and the Ochsner Clinic Foundation, claiming she suffered injuries after falling in a sloping hallway at the club.
