A former employee of an LA Fitness club in Carrollton, TX, has filed a sexual discrimination lawsuit against the Irvine, CA-based company.
The suit was filed last month in the Eastern District of Texas, Sherman Division, according to The Southeast Texas Record.
April Stewart, who was a salesperson at the LA Fitness club, claims she was sexually harassed by one of the club’s personal trainers, the newspaper reported. The alleged incident, which took place on July 28, 2011, consisted of “grossly offensive and threatening conduct” by the personal trainer.
The next day, Stewart sent an email to an employee relations manager detailing the incident. She claims the manager told her she could return to her job a few days later and that the personal trainer had been given a “stern talking to,” the newspaper reported. After Stewart disapproved of the response from the manager, she resigned, according to the newspaper. Her resignation was described as a “constructive discharge from her employment.”
LA Fitness had no comment on the lawsuit.
