BISMARCK, ND -- North Dakota legislators introduced a bill Wednesday that would eliminate the state’s requirements to keep operators on duty at tanning bed facilities.

In 2006, lawmakers drafted legislation to mandate that operators be on duty at all times, minors get parental consent to tan and tanning beds be sanitized after each use.

Owners of some key-card fitness facilities that have tanning beds in them, such as Anytime Fitness, argued that the law would hurt their business because they don’t have employees onsite 24 hours a day, and they would have to place limits on tanning time.

Local media reported that lawmakers were concerned that if the staffing requirement was lifted, it might also mean the elimination of other stipulations, such as bed sanitization.
