Once again, LA Fitness, Irvine, CA, faces a class-action lawsuit involving its cancellation policies with its monthly membership contracts.
The lawsuit was filed in the U.S. District Court for the Middle District of Florida by the Philadelphia law firm of Berger & Montague, P.C., which filed a similar lawsuit last year in the state of Pennsylvania.
The lawsuit in Florida was filed on behalf of former members of LA Fitness who have incurred at least one additional monthly billing charge after they attempted to cancel their monthly dues membership agreement. The lawsuit also was filed for current LA Fitness members who entered into monthly contracts which contain, according to the lawsuit, egregious cancellation provisions, forcing the members to pay for one or more months after they attempt to cancel their memberships.
LA Fitness, according to the members, breached its contract and violated Florida’s consumer protection laws known as the Deceptive and Unfair Trade Practices Act. The lawsuit contends that it is “virtually impossible” to cancel an LA Fitness monthly contract without being charged at least one or two months of additional dues, even when members follow the contract’s cancellation procedures.
